Agreement to our Legal Terms

Wadstrom Sàrl (GmbH/LLC), ('Company', 'we', 'us', or 'our'), a company Registered in the Swiss Commercial Register as CHE-348.271.094 at Rue de la Dude 42, 1196 Gland, and operates under the name Wadstrom.
Wadstrom Sàrl offers handyman, construction and other related services. 

We operate the website wadstrom.ch (the 'Site') as well as any other related products or services that refer or link to these legal terms (the 'Legal Terms')(collectively, the 'Services').
These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity ('you'), and Wadstrom Sàrl, concerning your access to and use of the Services. You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Legal Terms. If you do not agree with the legal terms, you are expressly prohibited from using our Services or buy or products.
The Services and products are intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use or register for the Services or buy our products.

 


1. Services
We provide handyman, construction and other related services and products. Our services may include, but are not limited to, carpentry, gardening, general maintenance- and renovation work. We will provide the services in a timely and professional manner, and will strive to meet or exceed your expectations. As a customer, you will do your best to make available to us a space, free of charge, where we can create a weather-protected and lockable storage area if this is needed for the project.
We reserve the right to refuse any order placed through the Services. We may, in our sole discretion, limit or cancel quantities purchased per person.

 


2. Liability and Insurance
We take all necessary precautions to ensure the safety of our workers, customers and any other person subcontracted by us for the project. Your project are fully protected. Any 3rd party, subcontractor or company that we involve in the project, where you are a customer, is also covered by our insurance as long as they are contracted by us as part of the project. In the event of any unforeseen circumstances or damages like bodily injury, fire, material- or pecuniary damage caused by our activities or those of our subcontractors, our professional civil liability insurance from Baloise covers a sum up to CHF 10,000,000 per insured event.

 


3. Payment
All our prices include sales tax (VAT/MWST/TVA/IVA). We accept payment by invoice, Twint and credit card. Full payment for our services is due upon completion of the work. For monthly plans, the first payment is made upon booking the service or before work begins. Payment is due 10 days from the invoice date. We reserves the right to charge up to 50% of the proposed offer before work begins. In cases where the material or component cost is a large portion of the total project, or exceeds CHF 10,000, we reserve the right to charge the cost of the material and an additional up to 20% of the total offer before work begins or order placed at a supplier. This will be stated in the offer or agreement between us and you.
In the event that payment is not made, we reserve the right to charge interest on unpaid amounts, and to take legal action to recover the amount owed. We reserve the right to incur a late payment fee of 2% per week of the unpaid amount plus administration charges of CHF 40 per reminder.
You agree to provide current, complete and accurate information for all purchases made from us. All payments shall be in CHF if nothing else is agreed upon. If your order is subject to recurring charges, then you consent to us charging your preferred payment method on a recurring basis without requiring your prior approval for each recurring charge, until such time as you cancel the applicable order. We reserve the right to correct any errors or mistakes in pricing, even if we have already requested or received payment.
 


4. Changes to Services and final price
We reserve the right to make changes to our services, pricing, and Terms & Conditions at any time. This can occur if the supplier raises their pricing or if any unanticipated, force majeure or unforeseen circumstance materializes after we have given you our offer. Any extra work done due to the above mentioned circumstances will be charged at CHF 80 / person hour plus transportation costs if nothing else is stated in the offer made to you. However, we will make every effort to inform you of any changes that might affect the final price.


5. Warranty and Guarantees
We warrant that our services will be performed in a workmanlike manner, and we will remedy any defects in our workmanship that are reported to us within 30 days of completion of the work. This warranty does not cover damage caused by misuse, abuse, or neglect.
For larger projects and for some products there may be a warranty period up to 5 years or longer. If this is the case it will be stated in the contract between us and you. The warranty on the components or materials supplied by us is on par with the supplier's warranty. Throughout the warranty term, the customer ensures that we will have access to the project site if needed. With the exception of any particular conditions stated in these General Terms & Conditions or the contract or agreement between us and you as a customer, the requirements of the Swiss Code of Obligations with regard to the business contract and the SIA 118 standard apply.

 


6. Termination of Services
In the event of termination of services by the customer, for any reason, upon written notice, the customer will be liable for payment for any work completed, material or components purchased, cost associated to contracts made with subcontractors and any other cost associated with the project that cannot be cancelled without costs, prior to termination.

If for any reason, upon written notice, we terminate the contract with you, any payments made for work or material not delivered will be repaid in full.
For Monthly plans the notice period is (from the last day of the month) 2 months for the 12-month plans and 1 month for 6-month plans, for both parties, and will be stated in the Plan Policy.   
For larger projects, all the aspects of this clause will be clearly stated and agreed upon in a written contract.

 


7. Jurisdiction
This Agreement shall be governed by the laws of Switzerland in which our business is located, and any disputes arising under this Agreement shall be resolved in accordance with those laws. If the dispute cannot be resolved out of court, the legal forum is Nyon, Canton Vaud.

 


8. Our intellectual property
We are the owner or the licensee of all intellectual property on wadstrom.ch, marketing, advertisements or information material used by us. Our content are protected by copyright and trademark laws and treaties around the world. Without the previous written approval from us, any use or replication of offers, estimates, sketches, research, or designs, that are the property of the our company, is absolutely forbidden. In the case of a violation of this clause, we reserve the right to seek damages. The content is for your personal, non-commercial use only. 9. Return policy
The customer acquires ownership of any materials that were part of the estimate and were supplied by us but were not used after the work was completed, and is to be paid in full. If material or parts are to be returned they normally have to be in an unused condition. Your ability to return components or materials will be impacted by the return policy of the supplier. Any returns of components or materials will be charged at CHF 60 per man-hour/person-hour if the return is made by us on your request if nothing else is agreed.
3rd party delivery costs are usually not refunded. 3rd party return costs are sometimes added depending on supplier.
